Welcome to Beyond Island Gem Car Rental Aruba. By making a reservation, renting a vehicle, or using our services, you agree to these Terms and Conditions. Vehicle rentals are also subject to the Rental Agreement signed at the time of rental.
1. Definitions
- "We," "our," or "us" refers to Beyond Island Gem Car Rental Aruba.
- "You" or "your" refers to the person making a reservation or renting a vehicle.
- "Vehicle" refers to any car, SUV, van, or other vehicle provided by us, including keys and accessories.
2. Rental Eligibility
To rent a vehicle, you must:
- Be at least 23 years of age.
- Have held a valid driver's license for at least two (2) years.
- Present valid identification and a valid driver's license.
Additional drivers must also meet these requirements and be listed on the Rental Agreement.
3. Reservation and Payment
A reservation is confirmed once accepted by Beyond Island Gem and any required reservation payment or deposit has been received. All prices are quoted in USD unless otherwise stated. Payment methods, taxes, card processing fees, optional services, and additional charges will be disclosed before payment.
Vehicle availability is subject to confirmation. If the reserved vehicle becomes unavailable, we may provide a comparable replacement when available.
4. Security Deposit
A refundable $200 USD security deposit is normally required unless another amount is specified.
The deposit may be used toward unpaid charges, vehicle damage, missing fuel, excessive cleaning, lost items, fines, towing, or other charges for which the renter is responsible.
Any remaining refundable balance will be returned after the vehicle has been inspected.
5. Cancellations & Refunds
Cancellations made at least 48 hours before the scheduled rental start time are eligible for a refund unless different terms were provided with the reservation. Late cancellations and no-shows may be charged up to the reservation amount. No refund is normally provided for early returns or unused rental days.
6. Vehicle Use
Only authorized drivers listed on the Rental Agreement may drive the vehicle.
The vehicle may not be used for:
- Driving under the influence of alcohol or drugs.
- Racing or speed testing.
- Illegal activities.
- Unauthorized commercial transportation.
- Driving on beaches, flooded roads, or prohibited off-road areas.
- Towing without authorization.
The renter is responsible for using the vehicle safely and lawfully.
7. Fuel, Cleaning & Vehicle Condition
The vehicle must be returned:
- At the agreed location, date, and time.
- With the same fuel level recorded at pickup.
- With all keys and accessories.
- In reasonably clean condition.
Charges may apply for missing fuel, excessive sand, stains, smoke or vaping residue, pet hair, lost items, or excessive cleaning.
Smoking and vaping inside our vehicles are prohibited.
8. Late Returns & Extensions
Rental extensions must be requested at least 24 hours before the scheduled return time and are subject to vehicle availability.
Unauthorized late returns may result in additional rental charges.
Failure to return the vehicle as agreed without contacting us may result in vehicle recovery or appropriate legal action.
9. Insurance, Accidents & Damage
Rental vehicles include the applicable insurance coverage required under Aruba law, subject to the insurance policy's terms, exclusions, limits, and deductible. The renter may remain responsible for damages or costs not covered by insurance. Accidents, theft, damage, or mechanical problems must be reported to Beyond Island Gem immediately.
In case of an accident, contact ForenSys Aruba at 165 when required.
Unauthorized repairs are not permitted without our approval.
10. Fines, Personal Property & Liability
Fines, Personal Property & Liability
The renter is responsible for traffic fines, parking violations, towing charges, and penalties incurred during the rental period. Beyond Island Gem is not responsible for personal belongings lost, stolen, damaged, or left inside the vehicle.
To the extent permitted by law, we are not responsible for indirect losses caused by events outside our reasonable control, including severe weather, accidents, government restrictions, or unexpected mechanical problems.
11. Privacy & Changes
Personal information is handled according to our Privacy Policy.
We may update these Terms and Conditions from time to time. The latest version will be published on our website.
Changes will not replace the terms already agreed to in an existing signed Rental Agreement unless required by law.
12. Governing Law & Contact
These Terms and Conditions are governed by the laws of Aruba.
Any dispute will be subject to the competent courts of Aruba, subject to applicable law.
